Introduction and Agreement

Welcome to diese9. These Terms and Conditions ("Terms") govern your use of this website and the professional audio services, including but not limited to mixing, mastering, and recording, (the "Services") provided by dièse9 ("we", "us", "our")

By accessing this website or engaging our Services, you ("Client", "you") agree to have read, understood, and be bound by these Terms. If you do not agree with these Terms, please do not use this website or our Services.

Scope of Services & Client Responsibilities

The Client is responsible for providing high-quality, clearly labeled audio files (stems) in the requested format for the project. The quality of the final master is directly dependent on the quality of the source files provided by the Client.

diese9 is not responsible for issues arising from poor quality source recordings (e.g., excessive background noise, distortion, timing issues, or vocal tuning problems) that were not explicitly agreed upon to be fixed as part of the initial project scope. Any such corrective work may be subject to additional fees.

For mobile recording services, the Client is responsible for ensuring the recording location is suitable and free from excessive noise.

Payment, Revisions, and Refunds

All Services require a 50% non-refundable deposit before any work commences. This deposit secures your project booking in our schedule. For mobile recording sessions, this deposit must be paid to confirm the session date and time. Any agreed-upon travel fees for mobile recording are due along with the final payment.

The remaining 50% of the payment is due upon the Client's approval of the final master preview or upon completion of a recording session. High-resolution, final audio files will be delivered to the Client only after the final payment has been received in full.

The quoted price for any Service includes up to two (3) rounds of revisions. Revisions are minor adjustments to the mix or master. Any additional revisions beyond the included three, or any work falling outside the initial project scope (such as adding new tracks or extensive editing), will be billed at an hourly rate of €50.

Due to the artistic and subjective nature of audio work, all payments are non-refundable once the Services have been rendered. The initial 50% deposit is non-refundable under any circumstances.

Delivery of Services

Upon receipt of the final payment, dièse9 will deliver the final, high-resolution audio files (e.g., WAV, AIFF) to the Client via a secure digital download link.

This download link will remain active for a period of thirty (30) days. The Client is responsible for downloading and securely backing up their files within this period. dièse9 is not responsible for storing Client files beyond this 30-day period.

Intellectual Property

Client Content: The Client warrants that they own or have obtained all necessary licenses and rights for the musical compositions and sound recordings provided to dièse9 for servicing (the "Client Content"). The Client shall retain 100% of the copyright, ownership, and all intellectual property rights to their Client Content. The Client grants dièse9 a limited, non-exclusive, worldwide license to use, modify, and transmit the Client Content solely for the purpose of performing the requested Services.

Portfolio Use: dièse9 may request to use a short excerpt (e.g., 30-60 seconds) of the final work for its professional portfolio on this website or social media. dièse9 will only do so with the Client's express prior written permission.

Website Content: All content, including text, graphics, logos, and software, on this website is the property of dièse9 or is used with permission or under license from third-party providers, such as royalty-free image libraries. This content is protected by international copyright laws and may not be reproduced without permission.

Privacy Policy

Limitation of Liability

In no event shall dièse9 be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our Services. The total liability of dièse9 for any claim arising out of or relating to these Terms or the Services provided shall not exceed the total amount paid by the Client to dièse9 for the Services in question.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Netherlands. The parties irrevocably agree that the courts of the Netherlands shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.

Changes to Terms

diese9 reserves the right to modify these Terms at any time. Any changes will be posted on this page, and the "Last Updated" date will be revised. Your continued use of the website or our Services after such changes constitutes your acceptance of the new Terms.
